| Annotation | The article is devoted to the protection of rights of participants of contractual relations within the legal regulation of the Civil Code of Ukraine and the Commercial Code of Ukraine, including possibility to apply measures of the operational impact according to the direct indication of law. Special attention is devoted to such method of protecting civil rights and interests by the court as recognition of transaction invalid. The correlation of the provisions of the Civil Code of Ukraine and the Commercial Code of Ukraine on protection of the rights of parties of the contractual relationship is considered in the article; namely regarding the place of agreement among sources of methods of violated rights protection, and also possibility to state in the agreement any methods of protection, that should not contradict to the law. |
