| Annotation | Some important aspects in implementation of the norms of Criminal Procedure Code of Ukraine governing pretrial proceedings, which author consider to be principal are covered. The influence of political part of Criminal Procedure Code of Ukraine on the process of effective implementation of its norms is demonstrated. The reasons for the negative attitude of employees of criminal justice authorities and scientists to judicial control over pre-trial production are analyzed. The author draws a conclusion on expediency of secret activity regulation in the Criminal Procedure Code of Ukraine that, in its turn, corresponds to European standards in criminal proceedings. The author proves the necessity to refuse from regulation of the notions «investigating officer», «investigating judge» as a positions and start to regulate them as functions. The procedural activity is proved to start before pretrial proceedings oceedings. |
